  	The will of John Earle of Tiverton dated 12 Feb 1718/9, proved 19 March 1727/8, names wife Mary Earle' sons John, Daniel and Benjamin; Dafters (sic) Mary, Rebaco and Elizabeth (no surnames). The inventory of the estate was dated 2 Feb. 1727/8. An agreement dated 3 March 1731/2 between JohnEarle of Kingstown RI; Daniel Earle of Tiverton; Benjamin Earle' Rebecca Earle, single woman; George Westgate and Elizabeth his wife of Warwick RI divided land of their grandfather Daniel Wilcocks late of Tiverton given by his will to their mother Mary Earle. The will of Mary Earl of Tiverton, widow, dated 26 April 1735, proved 28 May 1735, mentions "honoured father Daniel Wilcoks;" dau. Mary Earl; dau. Rebeckah Earl; all my children male and female; son Benjamin Earl exec.; cousin Philip Taber overseer. On 9 June 1735 John Earl of South Kingstown RI sold to brother Benjamin Earl of Warwick RI land in Tiverton which was given to their mother Mary Earl and her children by the will of their grandfather Daniel Wilcocks. [1] John had taken the oath of fidelity, or Freeman's oath, in Dartmouth before March 24, 1686, but he afterwards removed to Tiverton. Before this removal and in October, 1686, John Sprague, son of John and grandson of Francis Sprague, and Lydia, his wife, conveyed to him all right or claim of inheritance, in "one half of a purchase of Land Lying in ye township of Dartmouth, In ye county of Bristoll, where my uncle Ralf Earl now lives." This was the land which Francis Sprague gave to his son-in-law, Ralph Earle. In his will, which was executed February 12, 1719, he mentions his wife Mary; sons John, Daniel and Benjamin; and daughters Mary, Rebecca and Elizabeth. [2]
