- May 23, 1685, Benjamin Rice, of Sudbury, sued Dr. William Avery, of Boston, for malpractice. Verdict for defendant. In that suit, Daniel Pond testified that, "ten years ago, Benjamin Rice, of Sudbury, came to my house, in Dedham, with his feet frozen, and lodged there. Dr. William Avery's son, Benjamin, cut off one foot at the lowest joint, and stanched the blood with a masquash skin." Dr. William Avery does no appear, by the evidence in the case, to have therefore not chargeable to him, but to his son, Benjamin; hence the verdict. [1]
